Terms and Conditions for Using Education Programs

Online Course Terms of Use and Non-Transfer Agreement

This Agreement ("Agreement") is made and entered into by and between:

Points Club, Inc. ("Provider"), with its principal place of business at 1101 W. Church St., and

 ("Client"), anyone who signs up, pays for and agrees to enroll in online courses provided by the Provider.

1. License to Access Course Materials

Upon full payment of the course fee, Provider grants Client a personal, non-exclusive, non-transferable, and revocable license to access and use the course materials for educational purposes. This license is for individual use only, and the Client agrees not to share, copy, or distribute course content to any third party without prior written consent from the Provider.

2. Restrictions on Sharing and Redistribution

Client agrees that:

  • Course access is restricted to the individual who has registered and paid for the course.

  • Client shall not share login credentials, course materials, or any other proprietary content with any other individual or entity.

  • Client may not sell, resell, sublicense, or otherwise transfer access to the course materials.

3. Penalties for Unauthorized Sharing

If unauthorized sharing of course access or materials is discovered, Client agrees to:

  • Immediately forfeit access to the course without refund.

  • Pay a penalty of $300 for each unauthorized user accessing the course materials through the Client’s account.

  • Be liable for any legal costs incurred by the Provider to enforce these terms.

4. Confidentiality of Course Content

Client acknowledges that the course content is proprietary to the Provider and is protected by copyright law. Client agrees to maintain the confidentiality of the course materials and not to disclose, copy, or distribute them without written permission from the Provider.

5. Termination of License

Provider reserves the right to terminate Client’s access to the course materials without notice if these terms are violated. Upon termination, Client shall immediately cease all use of the materials and return or destroy any copies in their possession.

6. Refunds

The Provider does not offer refunds once the course has been accessed, except where required by law.

7. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the state of Florida, without regard to its conflict of law principles.

8. Entire Agreement

This Agreement constitutes the entire understanding between the parties and supersedes all prior agreements, whether written or oral, relating to the subject matter of this Agreement.

By enrolling in the course, the Client agrees to the terms set forth above.
